These Terms of Service ("Terms") are an agreement between you and Elites Match LLC, a New Mexico limited liability company ("Elites Match," "we," "us," or "our"). They govern your use of elitesmatch.com (the "Site") and our private, personal matchmaking services (together, the "Services").
By using the Site or submitting an application, you agree to these Terms. If you do not agree, please do not use the Services.
You must be at least 18 years old, legally able to enter a binding contract, and genuinely seeking a committed relationship. By applying, you confirm you are not prohibited by law from using the Services.
Membership is by application only. Submitting an application does not guarantee acceptance. We may accept or decline any application at our sole discretion, and we are not required to give a reason.
Membership details, fees, duration and specific terms are discussed privately during your consultation and will be set out in a separate written membership agreement. If that agreement conflicts with these Terms, the membership agreement controls.
You agree that all information you provide, including in your application, consultation, and photographs, is truthful, current and your own. You must disclose your actual relationship status. We may verify information you provide and may end your membership if we learn it is false or misleading.
Elites Match offers personal, human-led matchmaking: a consultation, curated introductions selected for compatibility, feedback after each introduction, and ongoing guidance.
We do not guarantee any particular number of introductions within a set time, that any introduction will lead to a relationship or marriage, or that any person will meet your expectations. Compatibility is a matter of human judgment and chemistry, which no one can promise.
We keep your information private and share your details with a potential match only with your consent, as described in our Privacy Policy.
In return, you agree to keep confidential any personal information you learn about other members or introductions, and not to share, publish, or post it without that person's permission.
You agree to treat every introduction with honesty, courtesy and respect. You will not harass, threaten, deceive, or solicit money from anyone you meet through the Services, or use the Services for any commercial or unlawful purpose.
Meetings with introductions are at your own discretion and risk. Elites Match does not conduct criminal background checks unless expressly agreed in writing and is not responsible for the conduct of any member, on or off the Services. Please use good judgment: meet in public places and tell someone you trust about your plans.
We may suspend or end your membership if you breach these Terms, provide false information, or behave in a way that we believe puts other members or our reputation at risk. Refunds, if any, are governed by your membership agreement.
The Site and its content, including text, photographs, design, and the Elites Match name and logo, belong to Elites Match LLC or its licensors and are protected by law. You may not copy, reproduce, or use them without our written permission.
The Site and Services are provided "as is" and "as available." To the fullest extent permitted by law, Elites Match disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Elites Match LLC and its members, managers, employees and matchmakers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your interactions with other people. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim arose.
You agree to defend and hold harmless Elites Match LLC from claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your conduct toward other members.
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in New Mexico, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us and try in good faith to resolve the matter informally.
We may update these Terms from time to time; the "Last updated" date shows the latest version, and continued use means you accept the changes. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your membership without our consent.
